Chen & Chang cooperated with Koll to enhance younger practitioners’ skills in examining experts in international arbitration. On 11 April 2024, a Mock Trial, focused on direct examination, cross-examination and redirect examination, took place online with Ms Claire Liu and Mr Frank Yu, Associates at Chen & Chang, representing both parties respectively and Ms Francesca Waldron and Mr Filippo Toniolo, Directors at Kroll, acting as expert witnesses. The training was based on the facts and expert reports of a simulated case prepared by Kroll.
Before the Mock Trial, our Associates read in the case files and had several one-on-one meetings with the Directors at Kroll to jointly design questions for cross-examination, akin to those in real international arbitration cases. During the Mock Trial, Mr David Falkenstern, Managing Director of Expert Services at Kroll, and our Managing Partner Dr Helena Chen C.Arb FCIArb acted as arbitrators to observe the performance of the counsel acting for the parties and the expert witnesses. Following the examination, David and Helena, based on their abundant experiences in international arbitration, provided their candid feedback by pointing out the strengths and weaknesses of each participant’s performance and generously shared their advanced examination techniques. All participants benefited tremendously from the training.
